TERMS & CONDITIONS

1.0 OUR QUOTATION
1.1 Our quotation for supply of goods will be prepared based on agreement between yourself and our designers and is valid for three month from the date of issue.
1.2 Your written acceptance (email is acceptable) is required before commencement of order.

2.0 CONFIRMATION OF ORDER
2.1 Confirmation of an order will be sent via email to the email address supplied by you.
2.2 Written acceptance is required before commencement of order.
2.3 This agreement is a binding and legal contract between you and the company. If any changes have to be made, these must be done via telephone and email.

3.0 FITTERS
3.1 Fitting, plumbing, tiling, electrical and building work will not be included in the contract.
3.2 Fitting is also a separate contract between you and the fitters.
3.3 At or following the pre-fit survey, the Fitter will advise you whether any supplementary work (which is outside of the standard installation package) is required. At this time the Fitter will indicate the cost of him/her carrying out such supplementary work and will confirm the price of supplementary work in writing.
3.4 You are under no obligation to use the Fitter to complete the supplementary work, you may use your own subcontractor to carry out the supplementary work. Any supplementary work which the Fitter or your chosen subcontractor agrees to carry out is outside of these Terms and shall be subject to a separate agreement for services between you and the Fitter or your chosen subcontractor. As such we accept no liability in respect of any damage arising as a result of any supplementary works carried out either by the Fitter or your chosen subcontractor.
3.5 If during the installation services, you agree with the Fitter to deviate from the plan, then this is your responsibility and we shall not be liable for any costs, damage or loss arising from this.
3.6 If the Fitter has agreed to carry out any supplementary works, the price for the supplementary works shall be as set out in written quote supplied by the Fitter and shall be payable in accordance with the Fitter's own payment terms.
3.7 If you appoint your own sub-contractor, rather than the Fitter, to carry out any supplementary works, you must ensure that the supplementary works are carried out with reasonable skill and care

4.0 PRICING
4.1 We are very careful to ensure that all our prices are correct. However, if we on a rare occasion we discover an error in the price of goods you have ordered, please contact us and we will look into the error.
4.2 Unless otherwise agreed in writing the price shall be due and payable in accordance with the applicable Octopuus Terms & Conditions of Sale at the same time as the Products.

5.0 RETAIL PAYMENT – SUPPLY ONLY
5.1 On confirmation of order a first payment of 50% of the total purchase price is due. On or prior delivery of goods the outstanding 50% is due. You will be contacted with a delivery date once the furniture is ready for delivery.
5.2 Failure to pay the outstanding balance will result in the delivery being delayed until the funds are received. No change from the above payment terms is permissible with express permission from the company. If you delay delivery, the payment will still be due.
5.3 If payment is overdue, Phoenix may recover any or all of the such goods and may without let or hindrance enter the buyer’s premises for this purpose.
5.4 From the advised due date of payment until settlement is made, Interest will be charged at the royal bank of Scotland base rate prevailing plus 3%

6.0 RETAIL PAYMENT
6.1 On confirmation of order a first payment of 50% of the total purchase price is due. On or prior to delivery of goods 40% is due. The remaining 10% is due upon completion of the installation. You will be contacted with a delivery date once the furniture is ready for delivery.
6.2 Failure to pay the outstanding balance will result in the delivery being delayed until the funds are received. No change from the above payment terms is permissible without express permission from the company. If you delay delivery, the payment will still be due.
6.3 If payment is overdue, Octopuus may recover any or all of the such goods and may without let or hindrance enter the buyer’s premises for this purpose.

7. 0 TRADE PAYMENT
7.1 Payment terms are agreed with each client, payment is required 30 days after the order has been delivered or collected or on the 28th off each month depending on the terms agreed. Failure to pay will result in all outstanding orders to be put on hold until the outstanding amount is settled.
7.2 If payment is overdue, Octopuus may recover any or all of the such goods and may without let or hindrance enter the buyer’s premises for this purpose.
7.3 From the advised due date of payment until settlement is made, Interest will be charged at the royal bank of Scotland base rate prevailing plus 3%

8.0 PAYMENT
8.1 If any information comes to the attention of Octopuus that gives Octopuus good cause to believe that the buyers ability to pay is in serious doubt or being a limited company and resolution or petition to wine up its business is passed, or if a receiver of any part of such company’s assets shall be appointed, or an administrator is appointed. Octopuus will have immediate rights to recover their goods as stated in clause 6.3 / 5.3 / 4.3 before expiry of the standard credit terms not with standing any variance that had been agreed in writing to those terms (but subject to paragraphs 42 to 44 of schedule B1 of the insolvency act 1988) Delivery of supply of any items will be deemed to be sufficient identification that the item is recoverable by Octopuus, Notwithstanding that the total value of goods recovered shall not exceed the total value of the debt

9.0 DELIVERY
8.1 Any damage or loss caused by persons not employed by the company such as builders or other tradesperson is the responsibility of the client. This can be discussed with the company at the time of damages or loss.
8.2 For goods that are installed by the company contactors shall be passed after installation. Damage in either case due to inadequate site access shall be at your risk.

10.0 DOORS AND WORKTOPS
9.1 The Company offer manufactures warranty for any manufactures defects that may occur. All faults must be made aware to the company within 7 days.
9.2 This warranty does not apply to any defect arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the company. Failure to follow company instructions on aftercare or alteration or repair carried out without the company’s approval.

11. 0 FITTING TOLERANCES
10.1 Voids and fillers surrounding the installed furniture are part of normal fitting tolerances and cannot be accepted as a reason for complaint.

12.0 CANCELLATION
11.1 Cancellation or orders will be accepted if the company has agreed in writing via email and on condition that you reimburse the company of all costs and expenses, losses or damages resulting from the cancellation.

13.0 WARRANTY ON ACCESSORIES
12.1 All goods such as lighting, storage units and fittings are warranted free from defects. All goods will be inspected by the company and will be repaired or replaced free of charge if found to be defective or damaged in any way. This warranty does not apply to any defect arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the company. Failure to follow company instructions on aftercare or alteration or repair carried out without the company’s approval.
